Mike McMorrow concentrates his practice on class action litigation. He has vast experience in consumer privacy and protection, consumer lending, warranty law, insurance litigation, utility ratemaking, and constitutional challenges under First and Eighth Amendments, standing and mootness, immunity, separation of powers and jurisdiction, as well as ample experience in complex commercial and regulatory litigation.

Mike's representative experience includes:

  • Gomez, et al. v. Campbell-Ewald Co. – Lead litigator in class action lawsuit involving violations of federal telemarketing laws in connection with $400 million advertising contract for defense agency. Litigated issues of mootness, constitutionality of statute, and derivative sovereign immunity at the trial court, Ninth Circuit Court of Appeals, and U.S. Supreme Court
  • In re Jiffy Lube Intl, Inc. Text Spam Litigation – Lead counsel in litigation and settlement of multiple class actions involving arbitrability standards and constitutionality of Telephone Consumer Protection Act of 1991 (“TCPA”) as applied to text message spam
  • PLM Transportation Equipment Co. v. Sahara India Airlines – Dispute regarding subpoena for president of foreign airline. Maintained primary responsibility for prosecution of subpoena, defeating personal jurisdiction defense. Extensive motion and discovery practice centered around novel issues of corporate presence in context of personal jurisdiction dispute and included near-daily briefing and argument of emergency and contempt motions. Establishment of jurisdiction led to multimillion dollar settlement of underlying liability
  • U.S. v. Homawoo – Pro bono defense of journalist asylum applicant. U.S. attempted to deport client to Togo, where client was wanted for charges of making false statements against government in his writings
  • Health Care Fin. Resources v. Areawide Realty Trust – Defense of commercial realty client against breach of contract claims by tenant. Prevailing in defense of motion to litigate injunctive issues prior to legal issues and strategic counterclaim resulted in settlement that included payment of all disputed rents to client and no recovery by counterplaintiff
  • Commonwealth Edison Co., Petitions of Lt. Governor Pat Quinn and Citizens Utility Board for Investigation of ComEd’s Participation in a Marketing Campaign by CORE – Defense of utility against separate petitions for investigations into company’s marketing campaign by independent organization. Novel legal issues included authority of regulatory body to investigate speech and funding of unregulated organization
